BC Services may modify this Agreement from time to time, and such modifications shall be effective immediately upon posting of the modified Agreement. 1. I am a consumer with an account(s) at B.C. Services, desiring to make a payment to satisfy a debt.
  2. I have read B.C Services Inc.’s Privacy Policy and agree to hold B.C. Services harmless for any and all claims related to my online transaction with B.C. Services.
  3. I understand that B.C. Services has created this website, www.paymybcsaccount.com, for the purposes of assisting consumers with payments by credit/debit card or check, and acquiring information on accounts. I agree that I am entering this website for the purposes of making a payment on my account(s), or acquiring information about my account(s).
  4. Payment Services. By accessing the Service, you authorize BC Services 1) to establish and maintain your payment authorizations and 2) to process your payments according to your instructions.
  5. Our Responsibility. BC Services will use all reasonable efforts to process all your payment authorizations promptly and properly, provided the authorizations are actually received by BC Services. BC Services will not be responsible for any failure to process a payment authorization that is not actually and completely received by BC Services for any reason, including user error, equipment malfunction, natural disasters or impediments, or inaccurate or incomplete information.
  6. This authorization shall permit B.C. Services to collect both variable and fixed recurring amounts and also variable and fixed one-time amounts that may be due from time to time between B.C. Services and myself. This authorization shall remain in place unless and until rescinded by me via a written directive to B.C. Services at least five (5) days prior to any date in which any electronic funds transfer is to occur, in order to permit B.C. Services sufficient time to act on it. In the unlikely event my payment is returned unpaid, B.C. Services may elect to electronically (or by paper draft) re-present my payment up to five more times. I understand and agree and authorize and permit B.C. Services to collect and return processing charge by the same means, in an amount not to exceed that as permitted by law.
  7. Timing. By providing BC Services with a payment authorization under the Service, you authorize BC Services to charge the Transaction Account to remit funds on your behalf to pay your bills owed to BC Services. It is your responsibility to make timely payment authorizations, so that the funds will arrive at BC Services before the date on which they are due. You should submit all payment authorizations to BC Services at least three business days before the actual due date for the bills not the late date. A business day means any day other than Saturday, Sunday, a federal holiday, or any other day on which banks in the United States are not generally open for business. You shall bear the risk and the responsibility for paying any late charges or penalties resulting from the late receipt of any payment made under the Service provided, however that BC Services agrees to waive late charges and penalties resulting from late receipt of payment, in the event that your payment authorization was made more than three business days before the actual due date and the payment is late solely due to BC Services failure to promptly process your payment authorization.
  8. I understand that no payment is considered complete until the transaction has been fully processed by B.C. Services. This includes check clearance or other clearance of funds by my bank or financial institution.
  9. I hereby agree to submit accurate information in all fields as I make my payment and understand that failure to do so may delay the crediting of my payment to my account(s).
  10. Bank or Financial Institution Limitations. In using the Service, you are requesting BC Services to make payments for you from your designated Transaction Account. If your bank or financial institution is unable to process a transaction if, for example, there are not sufficient funds in the Transaction Account to cover the transaction, or if funds in the account are unavailable for any reason, the transaction may not be completed. There may be limits or restrictions upon the number or frequency of payments that may be made from your Transaction Account under applicable law or under the terms of your agreement with the bank or financial institution maintaining the Transaction Account. BC Services obligations under the Service are subject to any such limits or restrictions, and BC Services has no duty to notify you of any such limits or restrictions.
  11. Electronic Funds Transfer Payment Authorization. If I am setting up a Preauthorized transfer as defined by 12 C.F.R. §205.10(b) of Regulation E for recurring payments, I hereby give my written permission and authorization to B.C. Services to electronically debit my account for amounts due and owing between B.C. Services and myself pursuant to our payment arrangements.
  12. By submitting payment information for electronic check payment, I am authorizing B.C. Services to reproduce this item as an ‘ACH Transaction’ for deposit on the date specified above. A transaction that is returned to B.C. Services for any reason may be subject to a returned item fee by your banking institution and B.C. Services’ bank. An ACH transaction will be produced utilizing the information from this form you are submitting. You also authorize subsequent attempts to clear this transaction if the transaction fails for any reason.
  13. By submitting payment information for credit card transactions, I agree that this User Agreement forms a legally binding contract between myself and B.C. Services, and that this Agreement constitutes a writing signed by you under any applicable law or regulation. Any rights not expressly granted herein are reserved by B.C. Services.
  14. I hereby give permission to B.C. Services to contact me regarding any problems with processing my payment.
